From the time I graduated from Kent State on May 4, 1970 having watched students murdered, and maimed with no indictments, EVER, to a time I had in a court room my where my second, forth, fifth amendments were summarily ignored by a judge who also configured, through motions, the verdict of guilty with the appellate court upholding this obvious breach of constitutional protocol because they all did the same thing in their lower court careers. Five case law examples were submitted all ignored based on the opinion these transgressions did not affect the guilty verdict.
Now here's how it works. Judges are almost never voted out of office which means the incumbent is assured of his job and judges know this. They also know they have no voters to answer to and so rule supreme. Bottom line, you get what you ignore.
Through apathy, the Constitution has become a moot point. Good luck to all you young folks, I suspect you will need it.

Rene, I believe you misunderstood the point of my comment. However, that's probably partly because the way I worded it, the universal "you" I intended can be read as a personal "you," because it followed a clause that contained "your."

Two and Three on the list are self-contradictory. "Being careful" does not seem possible if you are going to refuse to remain silent.

Our police forces are out of control. Our leadership, and our courts, no longer honor the Constitution of the United States.

If you've read much of my blog -- see, in particular, the Overlords post -- then you know that I'm well aware of what the police can do.

Obviously, any time one fights the government, it can have consequences. I still remember when I defended a gang murder case in another city, where my father lives. My father was such a good friend to the Sheriff that he had his cell phone number. The case resulted in a very hearty fight between myself and the Sheriff's Department there. Once, when I was leaving town, my father said that I should take care driving home, with an eye on my rearview mirror.

If you speak up, you will piss some people off. It is unavoidable. (I am using the universal "you" here.) But you cannot cower. You cannot turn into the same kind of fearful scared little rabbits who are epitomized by a Sheriff's Department and other governmental officials who are so frightened that they cannot allow the constitutional system of government our Founders set up to control how our nation works; instead, they have to continually subvert the Constitution and our laws.

I'm not as afraid of the Constitution as they are. I embrace it.

Rick, I'd like to invite you to attend the Occupy the APA protest on May 19 at Moscone Center in San Francisco. If you write to my email I can send you a poster of the event. It is about forced drugging of patients and outpatients, the bogus diagnostic labels now in the DSM and being used to make everyone seem mentally ill, and the use of certification by cops to sweep the streets and retaliate for contempt of cop. It seems it would be right up your alley and I hope you'll decide to give it your time. Thanks.

Rick, I don't think you should insult me after misunderstanding my comment. The police use every tool they have to shut people up and control them, and one of them is certification. Raub was certified for writing things on Facebook that some people didn't like. He is now being defended by the Rutherford Institute. What I meant was to warn you that you could be accused of being insane, that's all. I don't think you're insane, and my point 3 was to say that all of us should speak up before things get worse. I hope you continue to speak up, but you can't pretend it can't have consequences for you or anyone, because it can.

One of the many tragic things about this video is that the young woman is unable to articulate her injury enough to get the attention of the judge. While watching it I was thinking of arguments I would make to get something done sooner. But you shouldn't need a law degree to have meaningful access to the courts, or if you really do, at least appoint an attorney so her arguments can be made. It was such a grotesquely unfair situation from beginning to end.

I am far from OK with it. The government will never be able to protect the people from harm, unless they go to the point of complete pat downs for every person that is on the streets and complete searches at checkpoints throughout the country. But even then, safety will not be guaranteed, it is not possible in any way that I can see. Maybe I am just not creative enough to come up with a 100% lockdown method that is viable. All I can see from a worst/best case scenario is massively invasive policies and still having the result of an event with a large number of casualties occuring. I prefer to have my rights, I accept the risks of not living in a "safe" society.

I'm okay with it, in that I think this is the best of likely worlds. Any revolution or major change will lead to fewer rights and freedoms, not more.
Our rights are being eroded by consent or demand of the majority; why would now be a good time to ask for a referendum?
